Where do these things apply? Our firm represented a company that served as a subcontractor in a lawsuit against a main contractor in the field of air conditioning. As part of the lawsuit, the company we represented claimed that the main contractor had not paid it money for work it performed, as part of a major project at Ben Gurion Airport, totaling over half a million shekels.
The main contractor, on the other hand, claimed, as part of his statement of defense and counterclaim, that not only was the company we represented not entitled to any payment, but it should also be ordered to pay him an amount exceeding NIS 300,000, due to alleged 'negligent work', 'causing damage', and a host of claims, which he attempted to support, among other things, with an expert opinion from his side.
After 5 years of deliberation, submission of affidavits and opinions by both parties, and the holding of several evidentiary hearings, led by attorney Dov Kerner from our firm, a detailed and reasoned judgment was issued by the Magistrate's Court in Rehovot. In it, the court accepted the client's claim in its entirety, completely rejected the counterclaim filed by the main contractor, and ordered the main contractor to pay our client the full amount of the claim, plus linkage differentials and interest, reimbursement of expenses, and attorney's fees, for a total sum of over NIS 700,000.
