Another significant victory for our office in a complex real estate case in the Family Court in Petah Tikva. At the heart of the case: an attempt by a mother and her daughter to dispossess our clients of their property rights in half of an apartment in Tel Aviv, which were registered in their names by virtue of a will of the deceased. The plaintiffs claimed that the registration was done in bad faith, and that those rights should be registered in their names, based on an irrevocable power of attorney signed by the deceased, which they presented to the court. The cross-examination we conducted revealed the plaintiff's lack of credibility and completely collapsed her version of events. In the verdict, the court accepted all our claims, including those denying the validity of the power of attorney as a basis for a transaction transferring rights, and determined that the plaintiffs acted in bad faith.
The court, as stated, ruled in favor of our clients and ordered the plaintiffs to pay legal expenses in the amount of NIS 40,000.
