data-id=\"0795077\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Appointing a guardian is a process in which a person is appointed to manage the affairs and needs, physical and\/or financial, of someone who cannot do so themselves.<\/strong><\/p><p>Pursuant to the Legal Capacity and Guardianship Law, 1962, a guardian may be appointed for <u>Someone who is one of these<\/u>:<\/p><ul><li style=\"list-style-type: none;\"><ul><li>A person whom the court has declared incompetent.<\/li><li>A minor (under 18 years of age) whose parents have passed away, have been declared incompetent, or have been determined to be incapable of fulfilling their parental duties.<\/li><li>A graduate with special needs who is unable to manage their affairs.<\/li><li>An elderly person who reaches a state where they can no longer care for themselves or make their own decisions.<\/li><li>Hospitalized, examined, and found unable to express an opinion regarding a medical procedure for him.<\/li><\/ul><\/li><\/ul><p><u>To the role of guardian<\/u> One of these can be appointed:<\/p><ul><li style=\"list-style-type: none;\"><ul><li>A single individual \u2013 any person, whether the spouse of the person for whom the guardian is appointed, a relative, or an attorney.<\/li><li>Corporation \u2013 institution, foundation, non-profit organization, etc.<\/li><li>The General Trustee - The General Trustee is an official in the Ministry of Justice responsible for all aspects of guardianship and can himself be appointed as the guardian of a specific person.<\/li><\/ul><\/li><\/ul><p>A request for the appointment of a guardian must be filed by the spouse, parent, or other relative of the relevant person, or by a representative of the Attorney General, and it is submitted to the Family Court, in the vicinity of the residence of the person for whom the appointment is requested, or, in the case of a Muslim, to one of the Sharia courts.<\/p><p>The application will detail, among other things, the reasons for the need to appoint a guardian, the specific data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The facts stated must be supported by an affidavit attested by an attorney, as well as by additional relevant documents, depending on the circumstances of the request, including \u2013 an opinion from a psychiatrist or family doctor, a social opinion, an opinion from a committee for the diagnosis of intellectual-developmental disabilities, medical opinions in urgent cases, and so on.<\/p>\n<p>It is important to note that if the person's first-degree relatives (parents, siblings, and children over 18, and spouses) do not wish to be appointed as guardian, a letter of consent from them to the appointment of the applicant must be attached to the request.<\/p>\n<p>Also, if in the matter of the person, on whose behalf the request is submitted, there exists <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.ivri-kerner.co.il\/en\/%d7%a2%d7%91%d7%a8%d7%99-%d7%a7%d7%a8%d7%a0%d7%a8-%d7%95%d7%a9%d7%95%d7%aa-%d7%a1%d7%99%d7%a4%d7%95%d7%a8%d7%99-%d7%94%d7%a6%d7%9c%d7%97%d7%94\/%d7%a2%d7%91%d7%a8%d7%99-%d7%a7%d7%a8%d7%a0%d7%a8-%d7%95%d7%a9%d7%95%d7%aa-%d7%99%d7%99%d7%a2%d7%95%d7%a5-%d7%9e%d7%a9%d7%a4%d7%98%d7%99\/%d7%a2%d7%91%d7%a8%d7%99-%d7%a7%d7%a8%d7%a0%d7%a8-%d7%95%d7%a9%d7%95%d7%aa-%d7%99%d7%99%d7%a2%d7%95%d7%a5-%d7%9e%d7%a9%d7%a4%d7%98%d7%99-%d7%99%d7%99%d7%a4%d7%95%d7%99-%d7%9b%d7%95%d7%97-%d7%9e%d7%aa\/\">Continuing power of attorney<\/a><\/span>, The power of attorney will be attached to the proceedings.<\/p>\n<p>The court shall appoint as guardian the person it deems most suitable, in the circumstances of the case, for the benefit of the person for whom the application is filed, taking into account, where possible, their wishes, and with the aim of minimizing the infringement of the liberty of the person for whom a guardian is appointed, to the greatest extent possible. Accordingly, the court shall appoint a guardian only if the following conditions are met:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>The appointment of a guardian is necessary to prevent harm to the person's rights, interests, or needs.<\/li>\n<li>The goal for which the appointment of a guardian is required cannot be achieved while preserving the person's best interests in a way that least restricts their rights, freedom, and independence.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>After examining the request and hearing the position of the person for whom a guardian is requested, provided their condition allows it, the court shall issue an order appointing the guardian, in which it shall specify one or more of the following matters for which the guardian is appointed:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Property matters.<\/li>\n<li>Medical matters.<\/li>\n<li>Personal matters.<\/li>\n<li>A specific matter or specific matters that the court will determine.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>In addition, the court shall determine the duration of the appointment of the trustee, to the extent possible, for the shortest period required to achieve the purpose for which the trustee was appointed, and if necessary, shall specify in the appointment order, instructions for the trustee's actions, including conditions and restrictions regarding their actions.<\/p><p><span style=\"font-size: 0.8rem;\"><b>The process of appointing a guardian is, therefore, a complex procedure that must be handled with sensitivity and professionalism.
